To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
DAMAGE DEPOSIT / DAMAGE PROTECTION
A $59.00 non-refundable damage waiver is required and provides coverage for up to $1,500 in accidental damage to the property and its contents (excluding linens and terry items). Any damage exceeding $1,500 will be the responsibility of the Guest. If the reservation is made through a third-party platform, that platform’s damage policy may apply; however, by booking, Guest agrees to the terms outlined herein to the fullest extent permitted.
Guest Responsibilities:
• Guests are responsible for all damage to the unit and its contents beyond normal wear and tear.
• Guests are responsible for the repair or replacement cost of any damaged, missing, or destroyed items not covered by the damage waiver, including any costs exceeding $1,500.
• Shipping, delivery, labor, and installation costs associated with replacement or repair are the responsibility of the Guest.
Exclusions – Linens & Terry:
• The damage waiver does not cover linens or terry items, including but not limited to sheets, pillowcases, mattress pads, blankets, and towels.
• Linens and terry items that are stained, soiled (including but not limited to blood, bodily fluids, oils, cosmetics, self-tanning products, or food), or otherwise damaged beyond standard laundering recovery will be charged to the Guest at full replacement cost.
Standard Replacement Cost Guidelines (subject to actual cost):
• Bath towels: $25–$40 each
• Hand towels: $15–$25 each
• Washcloths: $8–$15 each
• Sheet sets: $75–$200 per set
• Pillowcases: $15–$30 per pair
• Mattress pads/protectors: $40–$150 each
• Blankets/duvets: $75–$250 each
Final charges may vary based on brand, quality, and availability.
Excessive Cleaning:
• The property is professionally cleaned prior to arrival. Guests are expected to leave the unit in a reasonably tidy condition.
• An Excessive Cleaning Fee of $300 will be charged if the unit requires cleaning beyond a standard turnover, including but not limited to: excessive trash, staining, bodily fluids, food waste, spills, strong odors, or any condition requiring additional labor or extended cleaning time.
Biohazard / Specialized Cleaning:
• Any presence of blood, bodily fluids, vomit, or other biohazardous materials requiring specialized cleaning or sanitation will result in a minimum $500 Biohazard Cleaning Fee, which may increase based on severity and vendor costs.
No Parties / Events / Unauthorized Gatherings:
• Parties, events, or unauthorized gatherings are strictly prohibited unless expressly approved in writing.
• Violation of this policy will result in an immediate penalty of $1,000, potential termination of the reservation without refund, and additional charges for any damage, cleaning, security, or disturbances caused.
Inspection & Documentation (Supports Claims):
• A professional cleaning and inspection, including date-stamped photos and/or video documentation, is completed prior to Guest arrival.
• Guests agree to notify management within 24 hours of check-in of any pre-existing damage or concerns.
• Guests acknowledge that failure to report issues within this timeframe may result in responsibility for unreported damages.

Mattress Policy:
• If any mattress is exposed to liquids of any kind, the Guest is responsible for the full cost of removal, disposal, replacement, delivery, and installation of a new mattress.
Platform & Claims Alignment:
• Guest agrees that documented evidence (including photos, videos, cleaning reports, and invoices) may be used to support claims for damages or additional charges.
• Guest agrees to cooperate with any claims process required by booking platforms such as Airbnb, Vrbo or Booking.com, including timely responses and payment of valid claims.
• Nothing in this agreement limits the Owner/Manager’s right to pursue reimbursement outside of platform resolution processes where permitted.
Authorization to Charge:
• By booking this property, the Guest authorizes LT Hawaiian Properties to charge the credit card on file for any damages, excessive cleaning, missing items, penalties, or other charges incurred during the stay that are not covered by the damage waiver, without additional prior approval.
• An itemized statement and supporting documentation will be provided upon request.
